01 · OPERATOR & SCOPE
Who operates HitsBay
HitsBay.com is operated by Sami Suonsivu, a private individual based in Thailand. In these Terms, “HitsBay”, “we”, “us” and “our” refer to that operator. “You” refers to a visitor or member using HitsBay.
These Terms describe the conditions for using the HitsBay website, member accounts, directory, community features, Splashpage Builder, Banner Builder and related hosted content. Please read them before creating an account, submitting content or publishing a page. If you do not agree to these conditions, do not use the member or publishing services.

02 · YOUR ACCOUNT
Keep your account accurate and secure
You must have legal capacity to enter into this agreement under the laws that apply to you. If you use HitsBay for another person or organisation, you must have authority to act for them.
- Provide accurate account information and keep it reasonably up to date.
- Keep your password private and take reasonable steps to prevent unauthorised access.
- Do not impersonate another person or use an account to evade a restriction.
- Contact us promptly if you believe your account has been compromised.
You are responsible for activity you authorise through your account. These Terms do not make you responsible for losses that applicable law requires HitsBay to bear.
03 · ACCEPTABLE USE
Use the service responsibly
You must not use HitsBay to:
- Publish unlawful content, threats, harassment, discriminatory abuse or another person’s private information without a lawful basis.
- Commit fraud, impersonate others, send spam, distribute malware, conduct phishing or mislead visitors about a destination.
- Infringe copyright, trademarks, privacy or other rights.
- Fabricate testimonials or payment evidence, manipulate votes or ratings, or make misleading earnings or traffic claims.
- Attempt unauthorised access, bypass security controls or deliberately disrupt the service.
- Use automation or excessive requests in a way that harms the website or other members.
Use of a traffic exchange or advertiser must also comply with that third party’s rules. Listing a service on HitsBay does not authorise prohibited traffic or promotional methods.
04 · YOUR CONTENT
You retain your rights and remain responsible
You retain ownership of content you create and submit, subject to any rights belonging to others. You must have the permissions needed for the text, images, logos, screenshots, links and other material you upload or publish.
You give HitsBay a non-exclusive, royalty-free licence to host, store, reproduce, display and technically adapt that content as needed to operate the features you use—for example, displaying your public splashpage or generating a banner or thumbnail. This licence is for providing and maintaining the service; it does not transfer ownership of your content to us.
You can remove content through available account controls or request help through Contact. Copies may remain temporarily in backups, where retention is legally required, or on third-party services outside our control. We do not claim a right to sell your original content separately under this licence.
Do not upload passwords, financial account details, government identification or private information that is unnecessary for a public submission. Redact sensitive details from payment screenshots.
05 · TEMPLATES & DESIGNS
Use creative assets within their permissions
HitsBay’s software, branding, templates and supplied artwork remain owned by their respective rights holders. Access to the builder does not transfer those ownership rights.
You may use the templates and supplied artwork made available to you as part of splashpages and banners you create with HitsBay. Do not redistribute or sell raw template files, software or standalone artwork unless you have separate permission. If an asset has additional stated licence conditions, those conditions also apply.
You are responsible for your offer’s wording, your referral destination and any third-party brand material you add. Check your published page and exported banner before sharing them.
06 · REFERRALS & BONUSES
Make promotional relationships clear
Members and other contributors may publish referral or affiliate links. A person sharing such a link may receive a commission, credits or another benefit if someone uses it. You must clearly disclose a promotional relationship where applicable advertising or consumer law requires it.
If you offer a personal bonus, describe who provides it, the qualifying steps, any limits, how it is claimed and when it will be delivered. Keep your offer accurate and honour the commitments you make.
Unless expressly stated otherwise for a specific offer, a member’s bonus is that member’s responsibility. HitsBay is not a party to an agreement between a visitor and an independent promoter, exchange or advertiser, and does not guarantee their commissions, credits, bonuses or payments.
08 · OTHER WEBSITES
Third parties set their own terms
HitsBay links to independent websites and services. Their operators control their content, availability, charges, privacy practices and contractual terms. A listing, link or member review is not a guarantee or endorsement by HitsBay.
Check a destination, its offer conditions and its privacy information before registering, sharing information or making a payment. HitsBay does not control how an independent service handles those transactions.
09 · SERVICE & BACKUPS
Check publication and keep copies of important work
We aim to maintain a useful service, but access may be interrupted by maintenance, faults or events beyond reasonable control. We do not promise uninterrupted availability, a particular number of visitors, conversions, earnings or any specific promotional result.
Keep independent copies of content important to you. A browser backup or checkpoint stays in that browser and is not the same as a successfully saved public page. Use Save & Publish when you intend to publish, check the result, and inspect the public page before sharing its URL.
Where a material service change or discontinuation requires notice or another protection under applicable law, we will follow those requirements.
10 · MODERATION & ACCESS
Protecting the service and its members
We may review, decline, restrict or remove content, or restrict an account, when reasonably necessary to address a breach of these Terms, an infringement complaint, a legal obligation, a security threat or a risk of harm.
Where reasonably practicable and legally permitted, we will explain the reason for a significant restriction and provide an opportunity to respond or correct the issue. Urgent safety or security concerns, or legal requirements, may require immediate action.
You can request a review through Contact. Include the affected page or account, what happened and why you believe the decision should be reconsidered. We will consider the information you provide.
11 · CLOSING AN ACCOUNT
You can stop using HitsBay
You may stop using the service at any time. Use available controls to unpublish or remove your content, and contact us if you want help closing your account or making a personal-information request.
Account closure does not erase obligations that already arose, or require removal of information we must lawfully retain. Rights and responsibilities that need to continue by their nature, including ownership, existing disputes and applicable legal duties, continue as necessary.

12 · RESPONSIBILITIES & RIGHTS
Your mandatory legal rights remain
HitsBay is responsible for its own acts and omissions to the extent required by applicable law. You remain responsible for your own content, offers, authorised actions and decisions about independent services.
To the extent permitted by law, HitsBay does not accept responsibility for the independent acts of third-party exchanges, advertisers or promoters, or for promotional results it has not promised. This does not exclude responsibility for our own conduct where the law imposes it.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or removes mandatory consumer rights or other protections that apply to you.
13 · LAW & DISPUTES
Contact us about a concern
These Terms are governed by the laws of Thailand, subject to any mandatory protections and rules that apply to you in another jurisdiction. This choice of law does not remove consumer rights or a right to bring a claim in a court available to you under applicable law.
We encourage you to contact us first so we can try to resolve a concern. This is not a requirement to give up a legal remedy, meet an unlawful deadline or delay urgent action. These Terms do not impose mandatory private arbitration.
14 · CHANGES & CONTACT
Keeping these terms up to date
We may revise these Terms to reflect service changes or legal requirements. We will update the date on this page and give any advance notice, explanation or opportunity to respond required by applicable law for material changes. A change does not retrospectively remove rights that have already arisen.
If you do not agree with a material change, you can stop using the affected service and contact us about your account or content, subject to your applicable legal rights.
